Terms and Conditions
1. About these terms
These Website Terms of Use (“Terms”) govern your access to and use of this website operated by Nabayn Limited (“we”, “us”, “our”), a company registered in England and Wales with company number 16954773, whose registered office is at 33 Norfolk Road, Ilford, IG3 8LQ.
By using the site you agree to these Terms. If you do not agree, do not use the site.
Professional services (software development, consulting, etc.) are provided only under a separate written agreement (e.g. statement of work, master services agreement). If there is a conflict, the written contract prevails for those services.
2. Acceptable use
You agree not to:
- Use the site in any way that violates applicable law or third-party rights.
- Attempt to gain unauthorised access to our systems, accounts, or data.
- Introduce malware, scrape the site in a way that impairs our systems, or conduct denial-of-service attacks.
- Use the site to transmit unlawful, defamatory, harassing, or infringing material.
We may suspend or block access where we reasonably believe a breach has occurred.
3. Intellectual property
Unless otherwise stated, content on this site (text, graphics, logos, layout, and software) is owned by us or our licensors and is protected by copyright and other intellectual property laws.
You may view and print reasonable extracts for internal business use only. You must not copy, modify, distribute, or create derivative works for commercial purposes without our prior written consent.
4. Reliance on information
Content on this site (including articles and case analyses) is for general information only. It is not professional advice (legal, financial, technical, or environmental). You should obtain independent advice before acting.
Case analyses summarise publicly reported events for educational purposes. We did not provide services to the organisations named in them.
The live demos use fictional businesses and sample data. Prices, figures and features shown in a demo are examples, not an offer. Each customer’s work and price are agreed individually in writing.
5. Limitation of liability
To the fullest extent permitted by English law:
- The site is provided “as is” without warranties of any kind (express or implied), including as to accuracy, availability, or fitness for a particular purpose.
- We exclude liability for indirect or consequential loss, loss of profit, loss of business, loss of data, or loss of goodwill, except where such exclusion is not lawful.
- Our total liability arising out of or in connection with your use of the website (other than under a separate services contract) shall not exceed £100 or the amount you have paid us in the 12 months before the claim, whichever is higher — subject always to the non-excludable liabilities below.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
6. Third-party links
The site may contain links to third-party websites. We are not responsible for their content or privacy practices. Following links is at your own risk.
7. Data protection
Our use of personal data is described in our Privacy Policy. Use of cookies is described in our Cookie Policy.
8. Suspension and changes
We may modify, suspend, or withdraw the site or any part of it at any time. We may amend these Terms by posting an updated version; your continued use after changes constitutes acceptance where the law allows.
9. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory protections for consumers where applicable.
